Plenary Session - We Can Do It! Fighting Back to Protect Judicial Independence Click here to read biographies of program participants.

Dahlia Lithwick, senior editor at Slate will provide an overview of the emerging themes on the topic of judicial independence, and how they are manifested around the country. Attention will be given to themes in the 2012 election, and results related to this topic. From the perspectives of the state, federal, and administrative law benches, the panel will address the importance of fighting back against attacks on judicial independence, ethical responses, the need to be vigilant, and to the importance of a long-range view. Additional topics addressed will be attempts by special interest groups to intimidate sitting judges, attacks on the independence of the federal judiciary, and challenges faced by administrative law judges.

Judith Resnik on “Representing Justice”
Yale Law School Professor Judith Resnik will speak about a book she co-authored with Dennis Curtis, “Representing Justice”. The book maps the icon of Justice, a woman with scales and sword, and traces the development of public spaces dedicated to justice, courthouses, exploring the evolution of adjudication to its modern form. The book also analyzes how Renaissance “rites” of judgment turned into democratic “rights,” requiring governments to respect judicial independence, provide open and public hearings, and accord access and dignity to “every person.”

This panel will look at the challenges that women lawyers and judges are facing as the world around them changes. We will look at issues in the Middle and Far East, as well as those much closer to home in the Caribbean and Venezuela.

Mindfulness is the practice of paying attention to the present moment. In recent years, mindfulness practices have become a topic of growing interest in both medical science and neuroscience research. Each panelist has practiced mindfulness meditation and found it beneficial to their personal and professional life. Dr. Reiss, a physician, will discuss the effect of chronic stress on health and Dr. Jha, a neuroscientist, will comment on recent research on the effect of mindfulness meditation on the brain. Judges Leesfield and McAliley, and Professor Rogers will share some of their mindfulness practices, offer mindfulness tips, and lead a discussion with the audience about how a mindful presence can enhance our effectiveness as judges in the courtroom, in chambers and in our personal lives

The centrality of the cyber world to our lives poses special problems for justice, equality, and privacy. This panel addresses judicial ethics and staff management issues related to the use of social media, civil liberties and sentencing issues for those charged with internet-based crimes or whose sentences include prohibitions on internet use, proposals for law reform that better capture cyberstalking and internet-based sexual harassment, as well as First Amendment and privacy concerns in the context of internet regulation.

The goal of any judicial system is to achieve justice; in our ever-shrinking and interdependent world you often cannot attain true justice without addressing cross-border components. This panel of judges and former judges from different parts of the world (United States, St. Lucia of the United Kingdom, Brazil and The Hague) will discuss the challenges that each of them faces judging in a necessarily international setting and how they each confront those challenges on a regular basis. Additionally, the panel will address whether a structure like that of Chapter 15 of the United States Bankruptcy Code, which allows judges in related cross-border insolvency proceedings to consult with one another, could be employed in non-insolvency matters – from business litigation, collections of judgments and family law and immigration matters, and if not, why not? What might work?

REGISTRATION

Conference registration fees are $595 for NAWJ members, $625 for non-members, $575 for guests, and $525 for first-time conference attendees who are NAWJ members (attending after the first three years of joining). ADDITIONAL SPECIAL OFFER: New NAWJ members, for whom attending this upcoming Annual Conference in Miami will be their first NAWJ Annual Conference (attending within the first three years of joining), are entitled to the special rate of $450. Attendee registration fee includes all educational sessions, receptions, meals, transportation to events listed in the program and use of the hospitality suite. Guest registration fee includes all of the above except educational sessions. Registration forms postmarked after the registration deadline of October 8, 2012 must include a $50 late registration fee.

INTERNATIONAL JUDGES SCHOLARSHIPS (CLOSED)

The National Association of Women Judges International Judges’ Scholarship program is funded by Robert M. Kaufman and The New York Community Trust and makes available support for individuals who want to apply for an award to attend the NAWJ 34th Annual Conference. Allowable expenses include total economy (economy/coach) airfare and lodging costs for shared rooms. (Alternative funds may be available for registration fees if needed.) Consistent with NAWJ’s guiding principles, the purpose of the International Judges’ Scholarship is to bring together judicial officers from around the world to share knowledge and experiences to promote and ensure fairness and gender equality in the judicial systems of all nations.

Eligibility
Judges from all countries other than the United States are eligible to apply for a scholarship.
